Terms of Service for Alterpix

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Alterpix website (the "Service") operated by Lemonberry Labs ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Image Storage and Deletion

Uploaded images and their AI-generated altered versions are stored on our servers for a maximum of 48 hours after you have completed your purchase and downloaded your generated images, or 48 hours after upload if no purchase is made. After this period, the images are automatically and permanently deleted from our servers. If you do not download your generated images within the 48-hour period, they will still be deleted. We take reasonable measures to ensure the security of your images during this storage period, as detailed in our Privacy Policy.

Intellectual Property

You retain ownership of any images you upload to Alterpix. By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify (for the purpose of generating the altered images), and store your uploaded images solely for the purpose of providing and improving the Service. This includes generating AI content based on your images.

This license terminates automatically when your images are deleted from our servers (after the 48-hour retention period or upon your request, as described in our Privacy Policy).

We may display *altered* versions of user-uploaded images as previews or examples on our website. We will *only* do this with images that have been *explicitly* permitted for this use by the user who uploaded them. We will *never* display original, unaltered user-uploaded images without explicit consent. A clear opt-in mechanism for allowing preview display will be provided within your account settings.

*We do not claim any ownership rights over the AI-generated content.* The ownership of any generated content is dictated by the current applicable laws, and may reside with you, the uploader, or be considered in the public domain. By using the Service, you acknowledge this uncertainty.

User Responsibilities

You are responsible for ensuring that you have the necessary rights and permissions to upload any images you submit to Alterpix. You agree not to upload images that are:

• Illegal, obscene, defamatory, threatening, or otherwise offensive.
• Infringing on the intellectual property rights of others (e.g., copyrighted images without permission).
• Containing viruses, malware, or any other malicious code.
• Violating the privacy of others, including uploading images of individuals without their consent where required by law.
• Depicting minors in a sexually suggestive or exploitative manner.

Prohibited Uses

You are prohibited from:

• Attempting to reverse-engineer, decompile, or disassemble any part of the Service, including the AI model.
• Using the Service for any illegal or unauthorized purpose.
• Using the Service to generate content that violates the User Responsibilities outlined above.
• Attempting to access or collect data from the Service through automated means (e.g., scraping) without our express written permission.
• Using the service in a way that could damage, disable, overburden or impair it.
• Reselling or redistributing the Service or generated images without our express written permission.

Account Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

You may terminate your account at any time by contacting us at support@alterpix.app or by using the account management page where you can delete your account. Upon termination, your right to use the Service will cease immediately. Any uploaded images associated with your account will be deleted according to our data retention policy (48 hours).

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

We make no guarantees about the accuracy, quality, or suitability of the AI-generated images. The results may vary, and we are not responsible for any unintended or unexpected outcomes.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
